井田之不可行,學者皆能言之,其說莫辨于蘇子,蘇子曰:井田成而民之死也,骨已朽矣!蓋苐言其難成也。若夫行之之不為利而為害,則蘇子未之及也。且愚以為殷周之世,蓋未嘗舉海內而盡井之也,請先正言其害:井田之法,方里而井,井百而成,成百而同,蓋百里之國,提封萬井而已,城郭溝塗,三分去一,故註疏之家,以為止于六千四百井,每井而八夫,為夫五萬一千六百,今世繁庶之邑,生齒有數,倍此者,其將何以給之?孟子曰:天下之生民乆矣,一治一亂。夫亂極而始治,其生必耗,治極而未亂,其生必繁,以百里之法賦之,其始也,必患其地之曠,而其終也必患其人之倍患,其地之曠,則虛其地以待其人,猶之可也,一再傳而地與人相得矣,自是而漸倍焉,其將何以給之?韓非曰:人有五子,不為多矣。夫一人而五子老而傳百畆,則授之長矣,自其仲以及其季,寸土之茅無獲焉,剖而耕,則非制也,是以慈父必憂其幼子,而賢兄必憂其有弱弟憂之而無以為計,産子將有不舉者焉。如是則骨肉之恩殘,慈孝之理虧矣。曰:閭井之田,宜有絶而歸于官者,因而賦之可也。今民户之絶者,令得以兄弟之子為嗣,富民之老而無子者族之不肖,人睥眤而竊幸其死,甚則毒殺行焉,彼骨肉也而若是,使閭閻之絶者,人得而取之,則隣里而産子也,將不為賀而為戚?如是則睦任之教廢,隂賊之計興矣!且絶者適而一耳,圜視而欲取之者,十將誰授?而可?必且差次其年之長幼,而等其分之疏戚交爭焉,則貪吏黠胥將狡焉而肆其慾,如是則請寄之途廣,賕賂之門啟矣!即有公中之長,覈其當而授之,飽其一九,猶然飢也,度其乆而終不可得,必相聚而為奸邪以幸旦夕之飽,如是則盜竊之權衆,刀鋸之用亟矣!聖人者,以仁義禮智治天下者也,骨肉之恩殘,慈孝之理虧,則喪其仁睦任之教,廢隂賊之計興,則喪其義。請寄之途,廣賕賂之門,啟則喪其禮,盜竊之羣衆,刀鋸之用亟,則喪其智,率天下而喪其仁義禮智以胥于大亂之歸者,必井田為之也,吾見其害之浮于利也,曰是則然矣。殷周之井田,通乎天下,自孟子迄于今無異說也,于何而得之?曰:得之。孟子、孟子曰:夏后氏五十而貢,殷人七十而助,周人百畝而徹。夫貢之更為助也,猶易為也。若既七十而助矣,民田之治為道途,浚為溝洫者,自一夫之間積而通之,以達于千夫萬夫如此,其多制也,驟而更為百畝,則向之為道途溝洫者,將墮之堙之以為田,而其為田者復治之。浚之以為道途溝洫雖盡,海內之田十年而不得耕,其勢猶未幾也。殷民之出于水火者,僅然生耳,烏得此十年之蓋藏,以盡廢其井而從事于畚鍤乎?將武王、周公別有道以廩食之也?且二聖人之在位亦幾耳,武王末受命,二年而疾疾瘳,三年又二年而致政焉,得此十年之暇而為之如?曰為之而未成,以待成康也。體國經野之未制,而驟興禮樂,號為功成,治定周公,無乃恥之,此得之孟子而為吾之說者一也。孟子曰惟助為有公田。由此觀之,雖周亦助也。當是時,周儼然東耳,燕、衛、魯宋以暨泗上諸侯,猶周之建國也,周而助焉,徴諸周而可矣,雖與亦之云,其詞何疑而不定乎?此得之孟子而為吾之說者二也。又曰使畢戰問井地,孟子曰:夫仁政必自經界始。夫滕文之昭也,而周之卜正也,諸侯盡徹,滕豈後焉?有其舉之,宜歸視諸故府,何咨于孟子?藉曰:有司失其籍矣。孟子之立言也,亦宜告以愆忘之過,而勉以祖武之繩今之教畢戰也,其詞若創云爾。使滕之君臣忘其祖而惟吾是師,其言不讓,無乃疚焉,有以知滕之向未徹也,此得之孟子而為吾之說者三也。又曰:請野九一而助國中什一使自賦。夫郊遂之殊于都鄙固也,孟子不以告齊、梁而獨以告滕何耶?豈非托之空言,則理可概舉,見之行事,則勢須區別乎?髙山之阿,廣川之隈,林麓沮洳險阻之隘,國乎其間者,其為郊遂也大矣,孟子不敢徑情于五十里之滕,而周先王乃膠柱于千八百國,何孟子之智而周先王之愚?此得之孟子而為吾之說者四也。他日又言曰:文王之治岐也,耕者九一。夫此之九一者,為殷之助耶?為周之徹耶?夫其助也,周之侯于商者四百餘年,其助也宜乆矣,何待文王?其徹也,天下盡助而周獨為之徹變,禮革制以自彰,其受命服事之誠,或不其然,又以知岐之田向未井也,田之向未井也,獨岐也與哉?此得之孟子,而為吾之說者五也。竊謂三代之治天下也,所為煩委曲折以制其産而養其民者,亦盡之于畿內焉耳。外諸侯之嗣者,各使物土之宜以自治,而不親授之以法,故殷之助止于亳,而周之徹止于岐,與東都魯之為徹也,則周公之教也,齊富以魚鹽,晉強以戎索,烏在其必井田哉?岐與東都之徹其乆而敝也,無有道之君子以通其變,而遂裂于商鞅、李悝之手,鞅之所開,則岐阡陌也,東都之畧,蓋有侵于晉而析于魏者焉。悝盡地力,其在是與魯與東遷之王,守其故而不變者也。田之不給,其民之愿者,去為商賈,而其亡頼者,羣而私養于權門,以為公室之禍。太史公曰:洛陽民多賈子家羈之,慮季氏也,曰隠民多取食焉,豈不灼然于前史哉?趙也,韓也、田,齊也,燕也,楚也。不聞其阡陌之開、地力之盡,而井田之迹,亦各無有存焉者,豈非其始之未嘗通行哉?敢以是補蘇子之畧?
