5  | 書張司獄巻册子後古者敬獄周公曰：其不誤于庶獄，獄不重乎？顧重獄者，謂夫都官作士，明刑司法，可為平亭簡閱焉耳。至司獄眇矣職，圜扉啟閉，灾瘐死生，以逮箯輿，搒掠之數日譏，而月較之平反不可啟，占而參豫之不可，然且世重焉者，豈非以獄吏之尊，其勢易虐也哉？然則欲其不誤難矣。江寧張司獄，世傳其有隱德，自方侍御，吳學士魏督學季司諫以下，皆藉其給事御史臺，時多所周旋，侍御學士皆為文記之，予至江寧，江寧人云：康熈辛亥，江寧郡灾，勢已延獄，君料囚無死法者，釋之，令歸鐍死，囚如干呼，與坐共飲，身具衣冠把酒望火，嘆曰：嗟矣！釋囚死，火囚亦死，寧釋之勿火也！死法死，火亦死，寧火之勿法也。既而火滅，君與死囚俱不死而前釋之者，不可還矣。于是復詣獄撿舉，請死于法，自卯逮酉，所釋囚穰，穰先後奔至，且有中道返不至家者，及料之少一人，則其為君獄訟臺者也。君曰：公等何為矣，豈吾釋公等時中其心耶？皆叩頭曰：非也。方君之釋之也，雖好生耶？詎無臨難懼變之情為之先乎？且囚東西走耳，假使以釋去之，故偶然動心，縱或來歸，寧能一一約無遺哉？夫吾等之所以如此者，誠不忍公之生平，哀矜惻怛，一旦且為我死也。君曰善。張君彚贈言為册子，索予書，遂書之，且告世之典獄者。 |
